In a case of imposition of National Security Act on a SP leader, the Supreme Court was taken aback. The judges questioned the counsel for the UP government whether NSA can be imposed in such a case. The Supreme Court questioned why the police did this and why the District Magistrate allowed it. The judges acquitted the SP leader in the NSA case and ordered his immediate release. The court, in its order, said that it was shocked to see the action taken by the police and administration of Moradabad by imposing NSA in the case of arrears of revenue.
A bench of Justice Sanjay Kishan Kaul and Justice Ahsanuddin Amanullah said in the verdict that after looking at the case, they feel that why there are allegations of paying political accounts through the administration and police in UP. It is clear to them that no effort has been spared to trap the accused. Looking at the case, it is clear that the police and the administration went beyond the limit and took this kind of action without using their brains.
Moradabad SP leader Yusuf Malik had appealed to the Supreme Court regarding the atrocities against him. Malik's case was argued by Advocate Wasim Qadri and Saeed Qadri. It was alleged that the Yogi government took away his client's freedom to take political revenge. Both lawyers told the Supreme Court that two cases were registered against Malik in March last year. In April, the Moradabad Police initiated action under Section 3 (2) of the NSA.
District Magistrate Moradabad allowed the police to do so without going to the bottom of the matter. He issued an order to arrest Yusuf under NSA on 24 April 2022 without looking at the evidence. Yusuf also appealed against this order in the Allahabad High Court, but due to the delay made by the government, the hearing could not be held. Meanwhile, two more orders were passed by the government, which were passed with malicious intent to strangle Yusuf's freedom.
The controversy started when the Municipal Corporation Moradabad pasted two notices on Yusuf's Samadhi's house regarding the arrears of house and water tax. This amount is about 23 lakh rupees. The first case was registered on 26th March last year. The administration alleged that Yusuf and others prevented officials of the Revenue Department from entering the property. Second case was registered on 27th March. In this, the municipal inspector alleged that he had sealed the disputed property but it was broken. Yusuf was not named in that case. After that NSA was imposed.
