No greater cruelty than making false allegations against woman's chastity: Delhi High Court

Recently, the Delhi High Court said that there can be no greater cruelty than making false allegations against the 'chastity' of a woman.

While ordering divorce to the woman, the court noted that the couple was living separately for the last 27 years. The Court on Wednesday approved a petition filed on the grounds of cruelty and abandonment.

The matter was heard before the division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna

"In the present case, it is easy to decipher the mental trauma as the appellant (woman) was working and the respondent (husband) was not working. There was a huge disparity in the financial status of the appellant and the respondent. The endeavours of the respondent to be able to sustain himself had admittedly failed," the Court said.

With this, the Delhi High Court on Wednesday approved a petition filed on the grounds of cruelty and abandonment. While ordering divorce to the woman, the court noted that the couple was living separately for the last 27 years.

The High Court said that the term mental cruelty is so broad that it can take within its ambit financial instability, which can be termed as a continuing source of mental cruelty towards the wife. This shows that 'mental toughness' cannot be defined in any straightforward parameter. The court stated that in order to ensure this, the circumstances and conditions of both the husband and wife must be taken into account.
