The Supreme Court on Thursday, overturned the Bombay High Court's decision regarding the caste certificate of Navneet Kaur Rana, the incumbent Member of Parliament (MP) representing the Amravati Lok Sabha constituency in Maharashtra.
The apex court's bench comprising Justice JK Maheshwari and Justice Sanjay Karol restored Rana's caste certificate, marking a pivotal moment in a legal battle that had significant political implications.
The case centered around the authenticity of Navneet Kaur Rana's caste certificate, which had been challenged before the Bombay High Court by Anandra Vithoba Adsul, a prominent Shiv Sena leader and former MP. Adsul alleged that Rana had obtained the certificate through fraudulent means to qualify as a candidate from the reserved category of Scheduled Caste (SC) for parliamentary elections.
Rana, who had recently joined the Bharatiya Janata Party (BJP) and was slated to file her nomination papers for the 2024 Lok Sabha elections from the Amaravati constituency, faced severe scrutiny over her caste credentials.
The Bombay High Court had ruled in favor of Adsul, nullifying Rana's caste certificate and imposing a fine of ₹2 lakh on her. The court found discrepancies in the documents submitted by Rana and criticized the functioning of the Scrutiny Committee responsible for validating her caste claim.
However, the Supreme Court's verdict came as a reprieve for Rana, as it deemed the decision of the Scrutiny Committee as compliant with the principles of natural justice and not warranting interference under Article 226. The bench emphasized the importance of considering the peculiar facts and circumstances of the case before reaching a conclusion. Consequently, the High Court's order was set aside, and Rana's caste certificate was reinstated.
The legal battle surrounding Rana's caste certificate had broader implications, given her political standing and the reserved status of the Amaravati Lok Sabha constituency.
