MLA Nitish Rane approaches Bombay HC challenging FIR lodged against him for allegedly making "communal" remarks

The Bombay High Court has taken action by issuing a notice in the case filed by BJP MLA Nitesh Rane. He is seeking the quashing of a First Information Report (FIR) lodged by the Panvel police. The FIR accuses Rane of making derogatory remarks on a regional TV channel, leading to charges of promoting enmity between groups, outraging feelings of a particular community, and violating the SC and ST (Prevention of Atrocities) Act.

The complaint against Rane was lodged by Advocate Amit Katarnaware, who alleged that Rane used the term "Dalit" to refer to another MLA and the TV channel for airing a word that has been "legally banned."

Additionally, it was claimed that Rane used inflammatory language in relation to the Muslim community in a separate news item concerning events at the Trimbakeshwar temple in Nashik.

The complainant asserted that five years ago, the Ministry of Information and Broadcasting had advised the media to use the term 'scheduled caste/tribe' instead of 'Dalit', and according to the complainant, the petitioner (Nitesh Rane) had contravened this guideline.

This year, in june the Panvel police conducted an inquiry and submitted a report stating that no offense was evident. However, the complainant was dissatisfied with this conclusion and subsequently appealed to the sessions judge.

On August 2, the sessions judge issued an order instructing the police to register an FIR based on Katarnaware's complaint.

Later, on 11th August, Nitesh Rane approached the High Court to request the quashing of the FIR against him. He argued that the FIR did not sufficiently demonstrate the commission of any offense and highlighted that the police themselves had previously shared the same opinion. While awaiting the hearing of his plea, Rane also sought interim protection against coercive measures and requested that no chargesheet be filed until the matter is heard by the court.
