Man Who Faked Sexual Identity Sentenced to 20 Years for Raping Minor

In a significant legal action, a local court in Bareilly, Uttar Pradesh, has convicted and sentenced a 22-year-old individual to 20 years in prison for sexually assaulting a minor girl after misrepresenting his sexual identity.

The verdict was announced on Tuesday, as confirmed by a local police officer investigating the case.

Superintendent of Police (City) Bareilly, Manush Pareek, revealed that the accused, Farin Kinar, initially claimed to be a female transgender. However, a medical examination ordered by the court and conducted at SGPGI Lucknow conclusively established the accused as biologically male.

The sexual assault occurred in the Mirganj area last August, when Kinar allegedly lured the survivor under the pretext of watching television. According to the police officer, the accused not only committed the crime but also threatened the victim with harm if she disclosed the incident.

"Hearing the case on Monday, Special Judge POCSO Court-3 Umashankar Khar found Farin guilty. The court considered the medical examination report and witness statements. Farin was sentenced to 20 years rigorous imprisonment along with a fine of ₹ 12,000," the officer said.

The court mandated that the fine imposed on the convict be directly awarded to the victim. During the legal proceedings, Farin's defense counsel had argued that the accused was transgender, dressed in women's clothing, and was "incapable of committing rape".

However, this claim was refuted by the medical examination ordered by the court, which conclusively established the accused as biologically male. The medical report from SGPGI Lucknow played a crucial role in the court's decision to sentence Farin Kinar to 20 years in prison for sexually assaulting a minor girl.
