The ruling was prompted by a petitioner who contested a trial court's decision mandating him to provide a monthly stipend of ₹ 1,500 to a woman with whom he had lived in a live-in relationship.
In a forward-thinking decision, the judges emphasized that the provision of maintenance cannot be withheld if there is evidence of cohabitation between the couple. The High Court referenced the trial court's determination, which established that the man and woman had been cohabiting as if they were married. Furthermore, taking into account the birth of a child within the relationship, the court affirmed the woman's right to receive maintenance.
