The Madhya Pradesh High Court at Jabalpur has denied bail to a man accused of sexually assaulting a deaf and mute minor girl, reaffirming the importance of the victim's testimony in such cases.
Despite the absence of the accused's DNA evidence, the court emphasized that the prosecutrix's account holds substantial weight. This decision comes after the accused's third attempt for bail, with previous applications being rejected due to both merit and procedural issues.
The accused, held since July 6, 2020, faces charges under various sections of the Indian Penal Code and the POCSO Act. Despite arguments from the accused's counsel regarding the lack of DNA evidence and delays in the trial process, the court stressed the significance of the victim's evidence already on record.
Addressing concerns over procedural lapses, the court directed the trial court to expedite proceedings and ensure timely summoning of witnesses. Failure to comply with these directives would be taken seriously, with the Superintendent of Police tasked with executing all necessary warrants.
Ultimately, considering the evidence and the accused's conduct, the court found no grounds to alter its previous decision and dismissed the bail application.
