Live streaming of court proceedings: SC agrees to consider Senior Advocate Indira Jaising's suggestions

On January 16, a three-judge Supreme Court bench led by Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala stated that the it would consider Senior Advocate Indira Jaising's suggestions for live streaming of court proceedings.

Senior Advocate Indira Jaising has petitioned before the Supreme Court for live streaming of not only constitution bench cases but also other cases of national importance. In the Petition, Ms. Jaising affirms that live telecast of such cases will increase access to courts, and will "negate the chances of any misreporting, errors or second-hand information". She made the following submissions at today's hearing: "There was a suggestion that the links be provided in the cause list. This was recorded in the last order. Can there be a status report on that? Second, the issue of having transcripts was dropped but as a more affordable option - the US doesn't livestream its proceedings but they audio record all proceedings and they archive it and it's available for later. It's a more affordable option. Further, the issues of national importance such as marital rape exception etc- may be live streamed."

While dictating the order, CJI DY Chandrachud assured Sr Adv Jaising that the court will, on an administrative level, consider the following-

  1. Live streaming links may be available on the cause list.
  2. In addition to live streaming the Constitution Bench, provisions may be made to live stream matters of national importance.
  3. Access to court proceedings may be permitted through audio transcripts.
