Labelling housewives as unemployed is inaccurate : Calcutta HC

In a case seeking compensation for a woman's death, the Calcutta High Court emphasized that labeling housewives as unemployed is inaccurate. The court acknowledged the immense economic value of the relentless work performed by housewives around the clock.

During the hearing of a 15-year-old case, Calcutta High Court Judge Justice Ajay Kumar Gupta emphasized the significant contribution of housewives within families. He highlighted that their continuous, year-round dedication to household duties without taking any breaks holds substantial economic value. Comparatively, if someone else were to perform the same responsibilities, they would be compensated.

Consequently, Justice Gupta stated that referring to housewives as unemployed is misleading; instead, they should be recognized as contributors to household income. As a result, the judge ruled in favor of a compensation of approximately Rs 6.5 lakh in the case of a housewife's demise.

In fact, in April 2008, a woman had died in a road accident in Kheergram, Bardhaman. His family filed a case in the Bardhaman Motor Accident Claim Tribunal regarding this incident. He demanded Rs 6 lakh as compensation, but the company against which the case was registered did not want to accept this demand. The company gave Rs 1 lakh 89 thousand 500 as compensation to the family.

The housewife's family filed a case in the Calcutta High Court. The lawyer, on behalf of the housewife's family, sought compensation by calculating the housewife's potential earnings from 2008 to her average age. But the company has said that the deceased had no income; hence, how can so much money be demanded from the potential earnings?

Rejecting the company's argument, the court ordered a compensation of Rs 6 lakh 41 thousand 200 to the family of the deceased housewife. The court said that this amount has been determined by calculating the interest rate on the housewife's probable monthly salary of Rs 3000.

However, since compensation of Rs 1 lakh 89 thousand 500 has already been given, the remaining Rs 4 lakh 51 thousand 700 will have to be paid by the company.
