The Kerala High Court has instructed the State Police Chief to assess whether the investigation into the alleged involvement of police officers in the Dr. Vandana Das murder case is being conducted adequately.
The court has issued an order for the State Police Chief to request the case diary and provide a report regarding specific concerns raised by the parents of Dr. Vandana Das, a 23-year-old who tragically lost her life earlier this year. She was fatally stabbed by an individual who had been brought in for a medical examination by the police.
The parents have claimed that the actions of irresponsible police personnel are not being properly scrutinized in the investigation. Senior Advocate P Vijaya Bhanu, representing the parents, also informed the court that the charge sheet appears to be leaning towards favoring the accused.
In response to these concerns, Justice PV Kunhikrishnan has instructed the Police Chief to listen to the parents regarding these issues and, if feasible, to submit a report within a period of two weeks.
In the order dated October 3, the court emphasized the significance of the case, in which a young doctor lost her life, and how it has deeply impacted the collective conscience of society. As a result, the court stated that, in its view, the State Police Chief should request the case diary for this case, listen to the concerns raised by the petitioners (the parents), address their grievances if feasible, and subsequently submit a report to the court. This report should be presented to the court within a timeframe of two weeks.
The court was reviewing the petition filed by Dr. Vandana Das's parents, in which they requested the transfer of the murder investigation to the Central Bureau of Investigation (CBI). The parents expressed concerns that the police might attempt to conceal their own security failures in this case.
In the early hours of May 10, Dr. Vandana Das tragically lost her life due to a stabbing incident. The perpetrator was identified as Sandeep, a school teacher, who had been brought to the hospital by the police for a medical examination following his involvement in a brawl.
The parents of Dr. Vandana Das, who are the petitioners in this case, subsequently filed a plea with the High Court. They alleged that the police officers were conducting the investigation in a negligent and indifferent manner, possibly to avoid taking responsibility and to conceal their own security failures.
The petitioners also asserted that despite their repeated inquiries, they received no response from the hospital and law enforcement authorities regarding updates or developments in the case.
The petitioners alleged that it appears as though the police are operating under the influence and pressure of certain higher-ranking individuals whom the petitioners are unaware of.
Consequently, the petitioners have requested that the investigation into their daughter's death be transferred to the Central Bureau of Investigation (CBI).
The petitioners expressed their apprehension that justice might not be served, and there is a risk of an unjust investigation, particularly in light of the fact that the police themselves played a role in the heinous crime that took place, as stated in their plea.
The next hearing on this matter is scheduled for October 18.
