The Kerala High Court has announced the introduction of an E-Post service facilitated by India Post, aimed at efficiently delivering legal documents like court summons, notices, and orders. This innovative service offers a hybrid delivery approach.
Advocates are permitted to utilize the e-Post service for delivering court documents under certain conditions. Specifically, when the court either orders service through e-Post or Speed Post, or when no specific delivery method is stipulated, advocates have the option to choose this service. However, if the court mandates service exclusively through Registered Post, the e-Post service is not permissible.
The e-Post procedure helps send a digitally signed notice to the designated e-Post nodal office based on the recipient's pin code. Subsequently, the postal department downloads and ensures delivery of the notice to the recipient within one day of its dispatch to the postal dashboard.
Initially piloted in Thiruvananthapuram, the state capital, the project is currently under trial. There are imminent plans for statewide implementation in the near future.
The circular introducing the service provides comprehensive guidelines for advocates, e-filers, and judicial departments on utilizing the e-Post service effectively. It includes detailed step-by-step instructions covering aspects such as filing procedures, payment methods, verification processes, and ensuring the proper delivery of notices.
