Keep Smugglers and Gamblers Out of Zilla Parishad Schools : Bombay HC directs Police

The Bombay High Court has instructed the Superintendent of Police of all districts to take the necessary measures to prevent smugglers and gamblers from accessing Zilla Parishad schools.

"The State of Maharashtra is directed to ensure comprehensive protection for these schools, including the deployment of guards and implementing measures to prevent entry of bootleggers, gamblers, drug peddlers, etc., particularly during nighttime after school hours. Furthermore, the authorities are expected to clear any encroachments on Zilla Parishad School premises in accordance with the legal procedures."

The division bench of the Bombay High Court at Aurangabad, consisting of Justice Ravindra Ghuge and Justice RM Joshi, was presiding over a Suo Moto Public Interest Litigation (PIL) concerning the poor conditions of schools under Zilla Parishad, Panchayat Samiti, Municipal Council, and Municipal Corporation jurisdictions.

The Suo Moto Public Interest Litigation (PIL) was initiated by the high court following a news report highlighting the plight of students from a purported'smart school' where electricity supply was disconnected. The report depicted students sitting on the floor amidst empty liquor bottles strewn around them.

In July 2023, the Bombay High Court constituted a committee for the inspection of schools within the jurisdictions of Zilla Parishad, Panchayat Samiti, Municipal Council, and Municipal Corporation. The committee, chaired by the Principal District Judge, includes members such as the District Collector, Education Officer of Zilla Parishad, Executive Engineer of PWD, and Superintendent of Police.

On March 22, the Superintendent of Police of Dharashiv submitted a report outlining measures to enhance security in schools. The report proposed the implementation of daily visits by Pink Pathaks to schools to provide reassurance to students and faculty while acting as a deterrent to potential threats. Additionally, the report highlighted plans for increased patrolling and monitoring by authorities.

In its order, the high court noted that as most of the committees had submitted their reports, it was considering the formation of a new committee, preferably chaired by a former judge of the court.

The high court additionally directed the Maharashtra State Electricity Distribution Company Limited (MSEDCL) to address the issues concerning electricity at three schools located in Chhatrapati Sambhajinagar district.
