Karnataka HC Rejects PIL Against State BJP Leaders for Alleged Hate Speeches

The Karnataka High Court has rejected a Public Interest Litigation (PIL) filed by a civil contractor, which sought action against several BJP leaders in the state, including MP Renukacharya, CT Ravi, Tejasvi Surya, and Prathap Simha, accusing them of delivering hate speeches.

Petitioner Mohammed Khaleeulla asserted that he discovered the alleged speeches on social media platforms. However, a division bench led by Chief Justice NV Anjaria found the accusations too broad and lacking in substantiation, describing the PIL as appearing to be "politically motivated."

The petitioner had referenced the Supreme Court guidelines on hate speeches established in the 'Tehseen Poonawalla' case. However, the court remarked that filing such a petition seemed to be driven by motives other than public interest. It concluded that petitions of this nature cannot be entertained as Public Interest Litigations (PILs).

The petitioner also sought a directive for the government to broadcast on TV, radio, and other media platforms, as well as on official websites of the State Home department and Police, stating that hate speech, mob violence, and mob lynching would lead to severe consequences.

Furthermore, the petitioner requested the government to take suo-motu action and file cases against individuals accused of making hate speeches that incite enmity between communities. The plea also called for the establishment of designated courts in each district to expedite the trial of hate speech and lynching cases, adhering to the Supreme Court guidelines to conclude proceedings within six months from the date of taking cognizance.
