In a noteworthy ruling, Justice K Natarajan of the Karnataka High Court has modified the conviction and punishment of an individual who squeezed another person's testicles during a heated quarrel. The court determined that the act constituted "grievous hurt" rather than an "attempt to murder."
The judge acknowledged that injuries to the testicles can be life-threatening if left untreated but found no evidence to suggest that the accused intended to commit murder. The absence of any deadly weapon also supported the court's view.
Consequently, the court reduced the appellant's sentence from 7 years to 3 years of rigorous imprisonment under Section 325 of the Indian Penal Code (IPC), which deals with causing grievous hurt.
The incident, which occurred during a festival procession, involved previous enmity between the appellant and the victim. The victim suffered internal injuries and had to undergo the removal of his left testicle.
Considering the age of the appellant and his responsibilities towards his children and aged parents, the court granted a reduction in the sentence. Additionally, a fine of ₹50,000 was imposed, with the victim receiving compensation from the collected fines.
The appellant's convictions for wrongful restraint and intentional insult were upheld.
