Karnataka HC Brands BBMP, BDA, and KIADB as 'Bad Litigants

On Monday, the Karnataka High Court made an oral remark criticizing the litigation practices of the Bruhat Bengaluru Mahanagara Palike (BBMP), the Bangalore Development Authority (BDA), and the Karnataka Industrial Area Development Board (KIADB), labeling them as Bad litigants.

Following the failure of the Bruhat Bengaluru Mahanagara Palike (BBMP) to comply with the High Court's directive from October 2023 regarding the submission of a report on schools under its jurisdiction, a Bench comprising Chief Justice NV Anjaria and Justice Krishna S Dixit remarked on the inadequacy of BBMP's actions.

Justice Dixit expressed his concern by highlighting that it is primarily in BBMP-run schools where marginalized communities have access to education, implying the significance of their compliance. He further conveyed his conversation with the Chief Justice regarding BBMP's attitude, reiterating the court's dissatisfaction with BBMP, BDA, and KIADB, branding them as poor litigants at best.

In the ongoing case, Senior Advocate KN Phanindra, acting as amicus curiae, informed the Court that the report submitted by the State government revealed a concerning fact: 123 schools had only one toilet available for use.

He underscored that according to the Right to Education (RTE) Act, separate toilets for boys and girls are mandated. However, despite this requirement, the government report highlighted that 69 schools were facing issues related to their toilet facilities.

He continued to draw the attention of the bench to the fact that BBMP had failed to submit the report on BBMP schools as directed by the High Court in October 2023. Advocate NK Ramesh, representing the BBMP, assured the court that the status report for BBMP schools in eight zones would be submitted within a week. However, expressing dissatisfaction, the Bench reiterated its stance that BBMP, along with BDA and KIADB, were poor litigants.

Following this, Advocate Nilofar Akbar, representing the State government, assured the court that an affidavit detailing the issues in the schools would be submitted. Subsequently, the Bench requested an action taken report from both the State government and the BBMP, scheduling the next hearing for March 27.
