Kangana vs Javed Akhtar | Sufficient grounds to proceed against Javed Akhtar for criminal intimidation

Today, the division bench of a magistrate court said that there were sufficient grounds to proceed against him on charges including criminal intimidation. However, no case is made on charges of extortion, the court said.

Earlier, metropolitan magistrate’s court had issued summons to Akhtar to appear before it next month.

The court in its detailed order made available on Wednesday has said that on the basis of complaint, verification of the complaint filed by Akhtar and statement of Ranaut’s sister Rangoli Chandel, it has come to a conclusion that there are sufficient grounds to proceed against Akhtar for offence under section 506 (criminal intimidation) and 509 (Word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code.

The Court directed Javed to appear in the court on 5 August.

Kangana and Javed Akhtar's physician Dr. Ramesh Agarwal appeared before the magistrate as a witness in the court on Monday. He talked about the meeting between Javed and Kangana and her sister Rangoli Chandel in 2016 and told the court that Javed had spoken to him about the issue between Kangana and Hrithik Roshan and said that there should be a settlement between the two actors.

In 2016, Javed Akhtar called Kangana to his house to give some advice on his dispute with Hrithik Roshan. In 2020, Kangana had said in an interview that he had threatened her for speaking on this issue and later filed a defamation case against her. After which Kangana lodged a complaint against Javed Akhtar.

During the hearing, when Javed Akhtar's lawyer Jai Bhardwaj asked the physician of both, Dr. Aggarwal about the derogatory words, he said that he did not hear it. Dr. Aggarwal said, 'This conversation lasted for about 20-30 minutes and before leaving, Javed told Kangana, you will have to apologise.' When Dr. Aggarwal was asked what did Javed say? 'Will you read or ask?' ThenDr. Aggarwal replied, 'Aap Mafi apologize' had said. However, during this, Dr. Aggarwal also told that no wrong words were spoken during this.

When Kangana's lawyer Rizwan Siddiqui asked Dr. Aggarwal whether Javed Akhtar had asked him to mediate between Hrithik Roshan and Kangana, in response to which Dr. Aggarwal said that he had become a part of this meeting on the request of Javed Akhtar. Describing the agenda of the meeting, Dr. Aggarwal said that the agenda was that both would apologize to each other. I didn't know that Javed would not call the Roshan family and would only ask Kangana to apologise.
