Johnson & Johnson moves Bombay High Court against license cancellation in State of Maharashtra

Johnson &  Johnson Pvt. Ltd. a leader in baby products in India and worldwide has moved a petition before the Bombay High Court against the order of Joint Commissioner & Licencing Authority dated 15.09.2022 canceling the manufacturing license of its baby power manufacturing in the State of Maharastra.

Earlier the Joint Commissioner & Licencing Authority, Food, and Drug Administration, Maharashtra by the order dated 15.09.2022 has canceled the company’s license, effective from December 15, 2022. The review of the company was also rejected by the Commissioner and the company was directed to stop production w.e.f. 15.12.2022 on the ground that the baby powder did not conform to the statutory requirements. 

Company J&J filed an appeal before the FDA which also got rejected on 19.10.2022 before a vacation bench of Justices N.J.JAMADAR &
SHARMILA U. DESHMUKH, therefore, a writ petition came to be filed. The case was listed before the court on 26.10.2022 when the company sought for a stay of the order till the pendency of the writ petition. The matter got adjourned to 09.11.2022 and the State was granted time to file its response.
