Promotion of the judge who convicted Rahul Gandhi questioned before SC
Congress leader Rahul Gandhi was convicted in a defamation case from Surat. The matter of the promotion of Judicial Magistrate Harish Hasmukhbhai Verma has reached the Supreme Court. The promotion of 68 judicial officers, including Verma, has been challenged. The Supreme Court will hear the matter on May 8. On March 23, Justice Harish Hasmukhbhai Verma who sentenced Rahul Gandhi to two years in the case related to 'The Modi surname', after which his MP went away.
The petition has been filed in the Supreme Court by two judicial officers of Gujarat's senior civil judge cadre, Ravi Kumar Mehta and Sachin Prajapati Mehta. Ravi Kumar Mehta is posted as Under Secretary in the Legal Department of the Government of Gujarat. At the same time, Sachin Prajapati Mehta is the Assistant Director at the Gujarat State Legal Services Authority. Both the officers have demanded in their petition that the promotion of 68 officers including Harish Hasmukhbhai Verma be cancelled and a list be prepared afresh on the basis of merit cum seniority.
The petitioners have claimed that there are many candidates who scored higher marks in the examination for promotion but were not selected. Rather, the candidate who scored fewer marks than them has been promoted. On April 28 itself, the Supreme Court expressed strong displeasure over the April 18 notification of the High Court through which the judges were transferred, as the matter is sub judice. The Supreme Court, considering it an interference in the work of the court, had summoned the reply from the secretary of the state government and asked that when the matter is pending before the court, there was the urgency to issue promotion and notification on April 18.
The Gujarat High Court had issued a notification on March 10, 2023. according to Harish Hasmukh Bhai Verma Hasmukhbhai Varma), a total of 68 judges have been promoted to the district judge cadre. These 68 judges had appeared in the examination conducted under 65% promotion quota and were successful. Who is Justice Verma?
Hasmukhbhai Varma is originally from Vadodara, Gujarat. He has studied Law (LLB) at the famous Maharaja Sayajirao College of Gujarat. Harish Hasmukhbhai Verma, 43, joined the judicial service after completing his LLB. Justice Verma's father has also been a veteran lawyer. Justice Verma is counted as a fast-paced judge in judicial circles. He is known to be very punctual.
