How could Rahul Gandhi save his membership?

Congress leader Rahul Gandhi has got a big blow. Lok Sabha Secretariat has canceled his membership of Parliament. In fact, the Surat court on Thursday convicted Rahul Gandhi in the defamation case and sentenced him to 2 years.

Rahul Gandhi's Lok Sabha membership has been cancelled. However, all avenues have not been closed for Rahul to retain his membership. He can challenge it before the High Court, where the membership can be saved if the decision of the Surat Sessions Court is stayed. If the High Court does not give stay, then the door of the Supreme Court will have to be knocked. In such a situation, even if a stay is granted by the Supreme Court, his membership can be saved. But if he does not get relief from the upper court, then Rahul Gandhi will not be able to contest any election for 8 years.

Rahul Gandhi's troubles may increase further. It is being told that if the High Court or the Supreme Court does not stay Rahul's conviction, then he will not be able to contest elections for 8 years.

Even if the High Court or the Supreme Court stays the sentence on Rahul's petition, his membership will not be reinstated. In fact, a ban is necessary even if Rahul Gandhi is found guilty for this.

Rahul Gandhi had said at an election rally in Kolar, Karnataka on 13 April 2019, "Why is the surname of Nirav Modi, Lalit Modi, Narendra Modi common? Why is the surname of all thieves Modi?

Regarding this statement of Rahul Gandhi, BJP MLA and former minister Purnesh Modi had filed a criminal defamation case against him under section 499, 500 IPC.

In his complaint, the BJP MLA had alleged that while addressing an election rally in 2019, Rahul defamed the entire Modi community by allegedly saying why all thieves have the surname Modi?

In fact, Congress leader Rahul Gandhi was convicted by the Surat court for 2 years in a defamation case filed regarding the statement containing 'Modi surname'. Rahul Gandhi made this statement before the 2019 Lok Sabha elections in Karnataka. The court suspended the sentence for 30 days while granting bail to Rahul on a personal bond of Rs 15,000. During this, Rahul Gandhi can challenge the sentence in the higher court. The court has said in its 170-page decision that the accused himself is an MP (Member of Parliament) and there was no change in conduct even after the advice of the Supreme Court.
