On January 23, Senior Advocate Meenakshi Arora raised the "hijab issue" before the Chief Justice of India for urgent listing, arguing that immediate interim orders are necessary to allow Muslim female students to sit for exams that are only held in Government colleges.
According to CJI Chandrachud, he will look into the situation and schedule a hearing before a third bench.
As a result of the government Pre University Colleges' ban on the hijab, according to Arora, the students have already lost one academic year and the Muslim girl students have had to transfer to private colleges.
"But the exams are to be held in government colleges. So the private colleges can't conduct exam. The practicals will start on 6th of February. We are only praying to take up the matter for interim directions", Arora submitted.
The senior attorney was making reference to the appeals filed in opposition to the Karnataka High Court's decision upholding the State Government's prohibition on Muslim girls wearing religious headscarves at public universities. A two-judge panel that heard the appeals in October 2022 reached a divided decision, with Justice Hemant Gupta supporting the ban on the hijab and Justice Sudhanshu Dhulia disapproving of it.
