High Court Grants Bail to Man, Orders Him to Salute Tricolor 21 Times While Chanting 'Bharat Mata Ki Jai'

The Madhya Pradesh High Court has granted conditional bail to a man accused of shouting pro-Pakistan slogans while saluting the national flag at a Bhopal police station. The accused, Faizal alias Faizan, must salute the National Flag and chant "Bharat Mata ki Jai" 21 times on the first and fourth Tuesdays of each month until the trial concludes.

Faizan was arrested in May following an FIR at the Misrod police station, where he was charged under Section 153B of the Indian Penal Code, which pertains to actions prejudicial to national integration. The court's order, dated October 15, stipulates that Faizan be released on a personal bond of ₹50,000 and one solvent surety of the same amount, ensuring his regular appearance at trial.

The court further mandated that he report to the Misrod police station on the specified Tuesdays, salute the National Flag unfurled there, and raise the slogan in question. Justice DK Paliwal emphasized that these conditions are meant to instill a sense of responsibility and pride in the applicant for his country.

The prosecution alleged that the accused's actions promoted enmity between groups and undermined national harmony. A charge sheet has been filed following the investigation.

In defense, Faizan's counsel argued that he had been falsely implicated, although it was acknowledged that a video shows him shouting the slogan in question. The state government's counsel opposed bail, highlighting Faizan's history as a habitual offender with 14 prior criminal cases against him, noting that he openly shouted slogans against the country of his birth.
