"Bombay High Court has deferred the hearing in the plea filed by gangster Chhota Rajan against the makers of the Netflix series 'Scoop.' The court noted that since the series has already been released, there is no urgency in the matter. The makers of the show have been granted time to respond to the plea, and the hearing has been rescheduled for June 7."
Chhota Rajan, who is currently incarcerated in Tihar jail, filed the suit alleging that the makers of the series have infringed upon his personality rights. Rajan claimed that the trailer of the show used his name, image, purported voice, and other unrelated names associated with him. In the suit filed before the commercial division of the High Court, Rajan sought damages of ₹1 for the alleged infringement.
Justice Dige questioned how the suit fell under the Commercial Courts Act when Rajan sought only ₹1 as damages. The court stated that if the suit qualifies as a commercial suit, it would be sent for mediation as per the legal procedure. Rajan requested time to amend the suit and include grounds that would satisfy the court that it is indeed a commercial suit.
Rajan's lawyer argued that out of all the individuals depicted in the series, only Rajan's real face and name were used. The lawyer expressed concerns about Rajan being portrayed as the one behind a murder, despite his conviction and pending appeal. The defense representing Netflix, an over-the-top (OTT) platform, informed the court that all six episodes of the series had already been released. They also mentioned that once a person is convicted, it is permissible to name them based on publicly available judgments.
The court asked about the implications if Rajan is acquitted on appeal and eventually adjourned the case.
