Gujarat HC introduces two dedicated benches for bail cases

The chief justice of Gujarat high court Sunita Agarwal while addressing a matter on Tuesday,  announced her intentions of abolishing the practice of providing long adjournments in cases pertaining to bail pleas. She also stated that the hearing of bail petitions shall be streamlined within a period of 30 days.

Justice Agarwal expressed her intentions to do away with the practice of frequently granting lengthy extensions in bail cases. She has also called  upon lawyers to collaborate and underscored the significance of their cooperation in implementing this change effectively. 

The judge while having a conversation with a senior advocate stated the following, “we are eliminating the practice of issuing Rule Nisi and putting off cases week after week. We are currently working on this. A new roster is in the making, and from October 5, two benches will solely focus on hearing bail cases.” Previously, Justice Agarwal has openly stated her desire to eliminate the practice of judges issuing 'rule nisi' and delaying bail hearings for extended periods of time.

Justice Agarwal expressed her astonishment at the continued existence of this practice and emphasized her intention to establish two dedicated benches exclusively for handling bail cases starting on October 5th.

She stated, “long adjournments will not be granted in bail matters. We've already communicated this. Everything should be systematized within a month, hopefully. We need cooperation from lawyers as well as the Public Prosecutor's office.”

In addressing a lawyer's concern about his client's prolonged incarceration and the need for additional benches, Justice Agarwal reassured him that the appointment of more judges is currently in progress. She conveyed her optimism about the evolving situation.
