Gujarat HC Grants Parole to Bilkis Bano Case Convict Following Father-in-Law's Death

Two weeks following the surrender of eleven convicts from the Bilkis Bano case at the Godhra jail, prompted by the Supreme Court's nullification of their remission, the Gujarat High Court granted parole to one of the convicts. This decision was made in light of the passing of his father-in-law.

Pradipbhai Ramamlal Modiya, one of the convicts in the Bilkis Bano case, petitioned the Gujarat High Court for 30-day parole following the demise of his father-in-law.

After reviewing the death certificate and the statement provided by the jail officer, Justice MR Mengdey approved Modiya's parole for a duration of five days.

"The petition is partly allowed. The petitioner is ordered to be enlarged on parole leave for a period of 5 days from the date of his actual release on usual terms and conditions, including furnishing a bail bond of ₹5,000 to the satisfaction of the jail authority. '' , the Court said.

According to the affidavit submitted earlier to the Supreme Court, Modiya has been granted a total of 1041 days on parole and an additional 233 days on furlough since he commenced serving his life sentence in January 2008.

Senior Advocate Shobha Gupta, representing Bilkis Bano, mentioned that Bilkis and her family had recently returned to their village, believing that the situation had calmed down.

The eleven convicts had been convicted for the rape of Bilkis Bano and the murder of her family members during the Gujarat riots of 2002. On August 14, 2023, they were released from prison following the grant of remission by the Gujarat High Court.

The remission granted to the convicts by the Gujarat government was based on a Supreme Court judgment from May 2022. In this ruling, the Supreme Court emphasized that remission applications should be evaluated according to the policies of the state where the crime occurred—in this instance, Gujarat—rather than where the trial took place (which was in Maharashtra).
