Former JNU Scholar Umar Khalid Challenges Discharge of Attackers in Delhi HC

On Wednesday, former JNU scholar and activist Umar Khalid took legal action by filing a challenge in the Delhi High Court. He contested the discharge of two individuals accused of attempting to murder him in a 2018 attack outside the Constitution Club of India.

Justice Anoop Kumar Mendiratta has issued a notice regarding the plea and has requested a response from both the Delhi Police and the two accused individuals involved in the case.

Khalid has contested an order issued by the trial court on December 6th of the previous year. This order discharged the accused individuals, Naveen Dalal and Darvesh, under Section 307 of the Indian Penal Code, which pertains to the offense of attempt to murder.

Nevertheless, charges were still framed against them for offenses under Section 201 and 34 of the Indian Penal Code, as well as Section 25 and 27 of the Arms Act.

During today's hearing, Senior Advocate Trideep Pais represented Khalid. He argued, "This is a new revision petition with egregious facts. The defendants arrived at the scene after planning their attack. The prosecution is in agreement with my stance. They monitored my activities on Facebook, located me, and acquired a firearm."

After listening to his arguments, the court has issued a notice regarding the plea and scheduled the next hearing for May 21.

Umar Khalid, the complainant in the case, claimed that in August 2018, when he arrived at the Constitution Club to attend an event, two individuals approached him, with one of them launching an attack.

Khalid alleged that the accused pointed a pistol at him, which he managed to deflect with his hand. The attacker fled the scene after Khalid's friends intervened.

According to the First Information Report (FIR), as the accused fled, Khalid heard a gunshot coming from another direction, and the pistol was found abandoned on the road.

The trial court, in discharging the accused individuals of the attempt to murder charge, noted that the statement and evidence on record did not demonstrate a clear intention by the two men to cause Khalid's death.
