In the Judgement of S Murugesan v. Commissioner HR&CE and others, the Madras High Court held that it is important not to cause any inconvenience to the students who are appearing for their board exams but stopping the annual temple festival is not the right thing to do.
The Court rejected a PIL seeking to put off the Panguni festival due to ongoing board exams. However, the division bench of Acting Chief Justice T Raja and Justice Bharatha Chakravarthy court directed the concerned village authorities not to use loudspeakers on the days of the examination.
"No doubt children can't be inconvenienced but stopping the festival is not a solution. The children can be made to prepare in a secluded place during the day. The exam is not only life. Festivals are also important."
In his Petition, the petitioner mentioned that both of his children were preparing for the upcoming board exams and the celebrations would adversely affect the preparation of the students and would be a source of distraction.
The court however was not in favour of this argument. It noted that thousands of children were preparing for the examinations while battling hurdles and thus an entire festival could not be stopped.
The court also took note of the State's submissions that anti-noise pollution norms will be strictly adhered to by the village authorities and all security arrangements will be made.
