The President of the Supreme Court Bar Association (SCBA) and Senior Advocate Vikas Singh has written a letter to the Chief Justice of India DY Chadrachud for the listing of the case related to life and health of the members of the Supreme Court Bar Association (SCBA). A letter has been written regarding the listing of the issue related to livelihood. Advocate Vikas Singh has submitted that we are also being treated like ordinary petitioners and are being discriminated against. The kind of preference that should be given is not being given.
Mr. Singh in his letter to CJI Chandrachud has said that 'the way we are being discriminated against, hope that such a situation does not arise that we have to resort to protest for our demand…'. Vikas Singh has written in his letter that it has always been the practice in the Supreme Court that on any given day the list matters are heard on the same day and ordinary matters are not heard on that day giving priority to the list matters.
Mr. Singh said "For the cases which are in the list, sometimes the petitioners come from far away or other cities, and the lawyers also have to do a lot of preparation."
Mr. Singh has written in his letter that 'his chamber plays a very important role in the life of a lawyer. During the tenure of former Chief Justice of India Justice NV Ramanna, 40% site plan of Chambers was prepared on the earmarked land. He himself wanted to lay the foundation stone of the Chamber Block. This is the last vacant land closest to the Supreme Court. The Bar Council had filed the writ petition so that chambers could be constructed on the entire 1.33 acres of land. The delay in this matter is affecting the livelihood of lawyers and members of the Supreme Court Bar Association…'.
Mr. Singh said "Let us tell you that the Supreme Court Bar Association has filed a petition in the SC and has sought an order to the Ministry of Urban Development to allot 1.33 acres of land located behind the Supreme Court to make chambers for Supreme Court lawyers."
Hearing the petition of the SCBA, the Supreme Court had issued notice to the Ministry on 12 September 2022 and fixed the date of next hearing of the matter on 3 November. However, the matter was later adjourned to November 21 and the hearing did not take place on that day as well. The next date of the matter was January 9, 2023, but on that day the bench got up at 4.30 am and the matter could not be heard. The matter was again mentioned on January 10 but no date was given for hearing.
Advocate Vikas Singh had also mentioned this matter before CJI Chandrachud on 10th January. Later, CJI Chandrachud made a sharp comment on the reaction of Advocate Vikas Singh and said that in our court, "Whatever I law down is the practice; do not try to dictate to CJI: CJI Chandrachud to SCBA President Vikas Singh".
