The Punjab and Haryana High Court has considered the wife's demand not to take care of her elderly mother and mentally ill sister as cruelty on the husband. The division bench of Justice Sudhir Singh and Harsh Bungar, while rejecting the petition filed by the wife challenging the grant of divorce, said that if the wife wants the husband not to take care of his 75-year-old mother and mentally ill sister, then he is being tortured. On this basis, the husband's demand for divorce can be accepted. The bench said that one has to give up one's freedom to some extent in marital life. It is wrong to expect the husband not to take care of the elderly mother.
The court said - It is clear that the emotional relationship between the two has ended: After looking at the records, the High Court said that the woman does not want her elderly mother and mentally ill unmarried sister to live with her husband. This demand is not fair. Husband and wife have been living separately since 2016. It is clear that the emotional relationship between the two has ended. In such a situation, both cannot live a normal married life.
