Delhi Riots bail pleas reopened after Justice Siddharth Mridul's elevation

The Delhi High Court will review the bail requests of individuals Sharjeel Imam and Khalid Saifi, who are facing charges in the broader conspiracy case linked to the Delhi riots. This decision follows Justice Siddharth Mridul's appointment as the Chief Justice of the Manipur High Court.

Starting in January 2024, a division bench consisting of Justice Suresh Kumar Kait and Justice Shailender Kaur will begin the proceedings to hear the appeals.

During the proceedings today, it was revealed that the special bench led by Justice Mridul had reserved its verdict in at least three bail pleas. However, due to Justice Mridul's elevation, these appeals will need to be re-argued.

The bail pleas have been submitted by several accused individuals, including Sharjeel Imam, Khalid Saifi, Gulfisha Fatima, Meeran Haider, Shadab Ahmed, Athar Khan, Shifa ur Rehman, and Salim Khan. Additionally, the bench will also consider the Delhi Police's appeal requesting the cancellation of bail that was previously granted to the accused Ishrat Jahan.

In October of the previous year, a special bench, which included Justice Mridul and Justice Rajnish Bhatnagar, had rejected the bail request of the accused, Umar Khalid, in the case.

FIR 59 of 2020 is under investigation by Delhi Police's Special Cell. This case has been registered under various offenses as per the Indian Penal Code, 1860, and also falls under the purview of the Unlawful Activities (Prevention) Act, 1967.

The accused individuals in the case include Tahir Hussain, Umar Khalid, Khalid Saifi, Ishrat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha, Shadab Ahmed, Tasleem Ahmed, Saleem Malik, Mohd. Saleem Khan, Athar Khan, Safoora Zargar, Sharjeel Imam, Faizan Khan, and Natasha Narwal. They are all facing charges related to the case.
