On Tuesday, the Delhi Police filed a petition in the Delhi High Court challenging the National Human Rights Commission's (NHRC) order, which criticized the police for alleged failure and negligence in carrying out their duties. This pertained to an incident where a murder accused, who was in Tihar jail, was taken to a court in Uttar Pradesh's Bijnor and was shot dead there.
Justice Subramonium Prasad issued a notice on the plea and granted a stay on the portion of the NHRC's order that directed the Delhi Police to pay compensation of Rs. 7 lakh over the death of the undertrial prisoner, Shahnawaz Ansari.
Shahnawaz, accused of double murder, was shot inside a courtroom in Bijnor on December 17, 2019, during ongoing proceedings. The Delhi Police had taken him to Bijnor for his appearance before the Chief Judicial Magistrate as part of the legal process.
The Delhi Police contended that the personnel tasked with escorting the accused to court are typically unarmed. They asserted that the failure to ensure adequate safety and security arrangements inside the courtroom was the responsibility of the Uttar Pradesh Police.
The court ordered the State to include the Uttar Pradesh Police as a party respondent in the case. Additionally, it appointed an amicus curiae to aid the court. The name of the appointed lawyer will be specified in the order once it is uploaded.
The matter will now be heard on July 18.
