Delhi Police Cancel First FIR Registered Under New Bharatiya Nyaya Sanhita (BNS) Against Street Vendor

The Delhi police's first FIR under the new criminal code, Bharatiya Nyaya Sanhita (BNS), against a street vendor was dismissed after they submitted a closure report in court on Tuesday.

Pankaj was booked on Monday for allegedly obstructing a public way in central Delhi's Kamala Market area, coinciding with the enactment of the Bharatiya Nyaya Sanhita (BNS) and two other new criminal laws. While the police initiated the process on Monday, it was formally cancelled on Tuesday after they submitted a closure report to the Tis Hazari court, according to a senior officer.

Pankaj was booked under Section 285 of the Bharatiya Nyaya Sanhita (BNS) for allegedly obstructing a public way while selling water bottles, bidi, and cigarettes from a cart under a foot overbridge near the New Delhi railway station around 12:15 am. The FIR was registered at 1:57 am on Monday.

"We are relieved but there is still uncertainty of whether we can carry out our business in the area," said Mithun who along with his brother owned the cart.

During a press conference on Monday, Union Home Minister Amit Shah stated that the Delhi Police had dismissed the case filed against a street vendor after conducting an investigation. "By utilizing the provisions of review, the police have dismissed this case," he remarked.
