In a sexual harassment case that was resolved through a settlement, the Delhi High Court has ordered the accused to provide Rs. 25,000 worth of woollen blankets to a shelter home for girls in the national capital.
Justice Jyoti Singh granted the accused's request to dismiss the FIR filed in 2014, which included charges under Section 354 (outraging the modesty of a woman), 354A (sexual harassment), 354D (stalking), 506 (criminal intimidation), and 509 (using word, gesture, or act to insult the modesty of a woman) of the Indian Penal Code, 1860.
Nevertheless, this condition would apply provided that the petitioner contributes a sum of Rs. 25,000 in the form of woollen blankets, which must be delivered to Kilkari Rainbow Home for Girls in Kashmere Gate, Delhi, within a period of four weeks starting from today," stated the court.
The accused argued that over time, and thanks to the involvement of relatives, mutual friends, and their families, he and the complainant had resolved their issues amicably. They formalized this resolution through a settlement deed that was executed between them last year.
The complainant, who participated in the proceedings virtually, informed the court that as the matter had been resolved amicably, she had no objections to the FIR being dismissed.
The Assistant Public Prosecutor (APP) representing the State also expressed no objection to quashing the FIR. The court was informed that the trial in the case had already concluded, and the case was currently in the stage of final arguments before the trial court.
Considering that the parties have reached a mutual settlement to resolve their disputes and in order to bring an end to the ongoing legal proceedings, this Court finds no justification to prolong the case, as it would not serve any beneficial purpose, the Court declared.
