The Delhi High Court emphasized the importance of thoroughly examining the statements of child victims in cases where a daughter accuses her father of attempted rape.

The court noted that in situations involving ongoing marital disputes between the parents, there is a potential for these disputes to influence the child's testimony.

Giving relief to the father, Justice Amit Mahajan's bench said that apart from the delay between the incident and filing of the complaint, it is also an important fact that the victim's mother and her father have filed a case against each other.

In such a situation, marital bitterness cannot be ignored by the court while deciding the bail application.
