Recently, the Delhi High Court is set to consider a policy to deal with the property of orphan children.
In a recent development, Justice Subramonium Prasad appointed Senior Advocate Dayan Krishnan as an amicus curiae in a specific case. The judge has requested Krishnan to provide valuable insights to assist the court in formulating a policy for cases involving children who have lost both parents.
The court was addressing a petition filed by two children whose father murdered their mother in September of the previous year, subsequently taking his own life. The children, under the care of the Child Welfare Committee, are currently residing at Udayan Ghar for Boys.
Despite the expressed willingness of the children's relatives to care for them, the children declined to go with their relatives. In a petition facilitated by the children's home, they conveyed their concern that the properties owned by their parents were being frittered away.
Consequently, with no viable alternative, the decision was made to approach the court and invoke its parens patriae jurisdiction to safeguard the best interests of the children, as conveyed to the court.
The court has subsequently called for the Delhi government's response to the plea made by the children and has set a deadline of two weeks for the submission of replies. The court is scheduled to further deliberate on the matter on December 6.
