Delhi HC Sought Status Report on Dheeraj Wadhawan's Bail Plea Following Trial Court Dismissal

On Wednesday, the Delhi High Court sought a status report regarding Dheeraj Wadhawan's bail application, which he has submitted on medical grounds. Previously, his bail plea was denied by the trial court.

The vacation bench of Justice Vikas Mahajan instructed the CBI to submit a status report concerning the bail plea and scheduled the matter for a hearing on June 10.

Senior advocate Amit Desai appeared via video conferencing, while senior advocate Siddharth Agrawal appeared in person. Advocate Anupam S Sharma represented the CBI and opposed the bail application.

Wadhawan's earlier bail plea was withdrawn from the Delhi High Court on May 17. He is accused in a CBI case concerning the DHFL multi-crore bank loan fraud. He approached the High Court after the trial court denied him bail twice. The Rouse Avenue court's Special Judge A.K. Sarpal dismissed his bail application on May 10 on the grounds of maintainability.

The court had also directed the CBI to arrest Wadhawan after May 11 and produce him before the CBI court, following the Supreme Court's directive issued on January 24.

While rejecting his bail application, the CBI Court at Rouse Avenue noted that Wadhawan could submit a fresh bail application after his arrest and subsequent custody by the court. The court stated that his request for interim bail on medical grounds or regular bail would be considered at that time.

However, after his arrest, the trial court dismissed his bail application. The court emphasized that the Supreme Court's January 24, 2024 order must be followed, requiring Wadhawan to be taken into physical custody.

Previously, the Bombay High Court had granted Wadhawan protection until May 11 on medical grounds. He was hospitalized, underwent surgery, and was receiving treatment at home after his discharge from the hospital before his arrest.

On January 24, the Supreme Court overturned a Delhi High Court decision that had granted statutory bail to former Dewan Housing Finance Ltd (DHFL) promoters Kapil Wadhawan and his brother Dheeraj Wadhawan in connection with a multi-crore rupees bank loan scam case.

The apex court revoked the bail granted to the Wadhawan brothers, stating that both the High Court and trial court had made errors in providing default bail to them.

"We have no hesitation that the chargesheet having been filed and cognisance being taken in due time, respondents could not have claimed statutory bail as a right. The High Court and lower court greatly erred. Trial court to hear afresh on regular bail. Appeals allowed accordingly," the bench said while pronouncing the order.
