Delhi High Court has set aside the decision of Delhi Mayor Shelly Oberoi calling for a re-election of six members of the Municipal Corporation of Delhi (MCD) standing committee.
Justice Purushaindra Kumar Kaurav ruled that Oberoi's decision to reject the ballot of one individual was legally flawed, as it lacked any material basis and was made without proper power or authority.
The court has instructed Oberoi to declare the election results based on the voting that took place on February 24. Additionally, the rejected ballot should be included in the vote count. The petition challenging Oberoi's decision was filed by two Bharatiya Janata Party (BJP) councillors, Kamaljeet Sehrawat and Shikha Roy, who sought the court's direction to declare the election results and cancel the mayor's notice for re-election.
Oberoi, a member of the Aam Aadmi Party (AAP), had previously issued an order calling for fresh elections to the MCD Standing Committee. However, the BJP councillors argued that the elections had already been successfully conducted, with both the BJP and AAP winning three seats each.
On February 25, the court had issued an interim order staying Oberoi's directions pending further proceedings.
