Delhi HC Restrains Vivek Bindra's YouTube Partner from Defaming Sandeep Maheshwari

Today, the Delhi High Court issued an injunction prohibiting Vikash Kotnala, the YouTube channel partner associated with entrepreneur Vivek Bindra, from publishing any content that could be deemed defamatory or disparaging towards YouTuber and motivational speaker Sandeep Maheshwari.

The bench headed by Justice Prateek Jalan issued the order after reaching a preliminary conclusion that there exists a connection between Kotnala and Bindra.

The court found that Kotnala's videos were potentially a means of evading a civil court directive that had previously prohibited both Sandeep Maheshwari and Vivek Bindra from disseminating defamatory content against each other.

On December 22, 2023, a civil court in Faridabad issued a restraining order against both Sandeep Maheshwari and Vivek Bindra, preventing them from making defamatory allegations against each other. This directive was a result of a case filed by Vivek Bindra.

Senior Advocate Sandeep Sethi, representing Sandeep Maheshwari, contended that Vikash Kotnala was allegedly instigated by Vivek Bindra to make the defamatory allegations against Maheshwari.

The reference was made to two videos posted by Kotnala, in which he claimed that Sandeep Maheshwari was attempting to extort money from Vivek Bindra and accused Maheshwari of utilizing students to eliminate a competitor, namely Bindra, from the market.

The High Court was informed that, despite Vivek Bindra being a defendant in the case, no specific order was being sought against him. This decision was based on the acknowledgement that both Bindra and Sandeep Maheshwari are obligated to adhere to the directives of the civil court's order.

"I don’t mean any disrespect, but this is some sort of war that is starting on these YouTube channels. It is not that I am seeing this for the first time. There seems to be a very low level of discourse during this fighting between some some rivals," the Bench remarked.

Finally, the Court concluded that Maheshwari had made a prima facie case and that irreparable harm would be caused if an injunction order was not passed.

Sandeep Maheshwari and Vivek Bindra have been engaged in a verbal conflict since December 11, 2023, when Maheshwari released a video titled 'Big Scam Exposed.' Although the video did not explicitly mention Bindra, social media users drew connections between the content and Bindra's activities, triggering the ongoing dispute between the two.
