Delhi HC Rejects Bail Petitions by BRS Leader K Kavitha in Excise Policy Case Today

Today, the Delhi High Court rejected BRS leader K. Kavitha's bail pleas in two cases of corruption and money laundering linked to the alleged excise policy scam.

On May 28, 2024, Justice Swarna Kanta Sharma's bench, following arguments from all parties involved, opted to reserve its decision on the matter.

K Kavitha was represented by Senior Advocate Vikram Chaudhari and Advocate Nitesh Rana, with additional counsel from Advocates Mohit Rao and Deepak Nagar. Advocate DP Singh appeared on behalf of the CBI, while Advocate Zoheb Hossain represented the Enforcement Directorate in the proceedings.

The CBI, in its opposition to the bail plea, argued that ongoing investigations are critical, particularly concerning the roles of other public officials, private individuals, and the financial trail of illicit funds. They emphasized that releasing the petitioner on bail could potentially obstruct the investigation, especially given her failure to satisfy the 'triple test' criteria established by Constitutional Courts in numerous precedents.

The Enforcement Directorate (ED), in its opposition to the bail plea, argued that in cases involving money laundering offences, standard conditions ensuring the accused's presence during trial or safeguarding evidence are insufficient. They highlighted the cross-border nature of such offences and the potential influence the accused could wield. Given current technological capabilities, the ED expressed concerns that the accused could anonymously tamper with the money trail, rendering both the investigation and trial ineffective.

Recently, the Enforcement Directorate (ED) filed a supplementary prosecution complaint (chargesheet) in the Excise Policy money laundering case in Rouse Avenue Court.

The chargesheet was filed against BRS leader K Kavitha and other accused, namely Chanpreet Singh, Damodar, Prince Singh, and Arvind Kumar.
