The increasing incidents of teachers and professors sexually harassing students have raised concerns, as highlighted by the recent statement from the Delhi High Court.
Justice Chandra Dhari Singh emphasized that such actions constitute a grave offense and represent an abuse of power and authority.
“Teachers are gifted with the power to impart wisdom and shape the minds of children who are the future, and it is imperative that such power is not misused.''
Furthermore, the Court elucidated that the relationship between a teacher and student is profoundly sacred, with the teacher holding a significant responsibility in fostering the comprehensive development of the student.
“The relationship between students and teachers dates back to the Vedas and runs through every epic that has overcome evil. Such a relationship is that of knowledge and devotion.''
The Court made these remarks in the context of addressing a plea submitted by Dr. Amit Kumar, a professor at Delhi University's Bharati College, who was suspended following accusations of sexual harassment made by students. Kumar approached the High Court to contest the University's decision to recover ₹6.42 lakh from him, which the DU claimed was an overpayment made to him.
After deliberation, the Court ruled that DU is not entitled to recover the amount from Kumar, as it had been disbursed to him before his suspension was officially approved by the Vice-Chancellor.
Advocates Vishwendra Verma, Shivali and Archit Verma appeared for Dr Amit Kumar.
Bharati College was represented through advocates Beenashaw N Soni, Mansi Jain and Ann Joseph.
