The Delhi High Court has ruled for the relocation of a mosque and madrasa situated in Sarai Kale Khan's Hazrat Nizamuddin area, clearing the path for civic authorities to proceed with their demolition.
Justice Amit Sharma of the vacation bench dismissed the plea filed by Faizyab Masjid and Madrasa, which sought to challenge the authorities' decision to demolish the structures.
The court's ruling followed an undertaking by the mosque's caretaker to vacate the premises within one month and guarantee that no further attempts would be made to impede the demolition process.
"In view of the undertaking given by the caretaker of the petitioner before this Court, respondents Nos 1 and 2 are directed to grant a period of one month to the petitioner or any other person claiming through it to vacate the subject premises i.e Mosque and Madrasa situated at Khasra No 17, Bhehlolpur Khadar, Sarai Kale Khan, Hazrat Nizamuddin, New Delhi," it ordered.
The court emphasized that no extensions would be permitted beyond the specified timeframe, underscoring the property's imperative for public purposes.
Upon receiving the caretaker's assurance, the petitioner's counsel requested to withdraw the petition. Subsequently, the court dismissed the plea upon withdrawal.
The initial plea contested the Delhi Police and Delhi Development Authority's (DDA) plans to demolish the mosque and madrasa set for June 13. The petitioner contended that the demolition was unlawful, arbitrary, and unconstitutional. Furthermore, the plea requested that the authorities furnish the petitioner with copies of the orders, meeting minutes, and file notations that culminated in the decision to demolish the structures.
The petitioner also requested sufficient time to pursue appropriate legal remedies and sought a status quo until these measures could be pursued.
