The Delhi High Court has issued an order instructing numerous media outlets, along with major online platforms such as Facebook, Google, and YouTube, as well as unidentified entities, to remove any news reports or media links containing purportedly defamatory and digitally manipulated images of a female Bharatiya Janata Party (BJP) MLA from Bihar.
On February 20, in an interim ruling, the Court additionally prohibited numerous news platforms from disseminating the images. These images depicted the lawmaker in a purportedly intimate situation with a former political ally, with whom she currently holds differing views. The legislator asserted that the images were digitally altered.
Justice Prateek Jalan, in issuing the directives, clarified that the order does not prevent news platforms from covering the factual controversy surrounding the viral images or the legal proceedings initiated in response. However, he stipulated that such coverage must refrain from casting doubt on the authenticity of the images and must accord equal prominence to the MLA's assertion that the images are digitally manipulated.
The MLA brought her case before the court, contending that digitally altered and defamatory images of her had been circulated on social media and disseminated by multiple media outlets. She asserted that these images were posted by her former political associate. However, the legal representative for the aforementioned political associate refuted the claim, denying any involvement in uploading the images onto social media platforms.
After evaluating the case, the Court determined that a prima facie case existed warranting an interim order, as the absence of relief could result in irreparable harm and injury to the legislator. Consequently, the Court issued an injunction order. Senior Advocate Rajshekhar Rao, alongside advocates Vrinda Bhandari, Vishakha Gupta, and Anandita Rana, represented the BJP MLA in the proceedings.
