The Delhi High Court has issued a restraining order against Geetanjali Salon, prohibiting them from playing songs that are copyrighted by Phonographic Performance Limited (PPL) without acquiring the necessary license.
Justice Anish Dayal issued an ex-parte ad interim order, recognizing that Phonographic Performance Limited (PPL) has presented a prima facie case for the injunction's grant. The court noted that PPL would face irreparable harm if the injunction were not granted.
“Defendants, its directors, partners or proprietors, and any other person working for and on their behalf are restrained from exploitation/ use of plaintiff’s copyrighted works in the repertoire available on plaintiff’s website https://www.pplindia.org/songs at any of its premises, including but not limited to the list of outlets which have been made a part of documents of the present suit, which amounts to infringement of plaintiff’s copyright,” the Court ordered.
PPL brought the case before the Court, accusing Geetanjali of copyright infringement by playing songs without obtaining the necessary license, which they argued constituted infringement. They specifically highlighted 25 Geetanjali salons where the unauthorized playing of PPL's songs allegedly occurred.
Phonographic Performance Limited was represented by Senior Advocate Chander M Lall along with the team of Khaitan & Co led Mr Ankur Sangal, Partner, Raghu Vinayak Sinha, Associate and Shaurya Pandey, Associate.
