Delhi HC dismisses Future Group's request to terminate the arbitration initiated by Amazon at SIAC

The Delhi High Court today rejected Future Group's petition challenging the Singapore International Arbitration Centre's (SIAC) order dismissing the Indian retailer's request to stay the arbitration proceedings with Amazon Inc. on November 22. This allows Amazon to continue its arbitration proceedings with Future Group, which will begin on November 28.

The arbitration before SIAC will continue, according to single-judge Justice C Hari Shankar, who has stated that he has not expressed an opinion on the merits of the arguments raised by the parties. The arbitration relates to Amazon's 2019 acquisition of a 49% stake in Future Coupons Private Limited (FCPL) and is one of several legal disputes in which the companies are involved.

On November 17, the Supreme Court stated unequivocally that it will not allow the stalling of arbitral proceedings pending before the Singapore International Arbitration Centre (SIAC) pertaining to the ongoing legal squabble between US e-commerce behemoth Amazon and the Future Group, stating that the sanctity of such proceedings must be preserved.

The US e-commerce giant had also sought compensation from Future Group for its $1,400 crore investment in Future Coupons.

On June 28 of this year, the tribunal denied two applications filed by the Future Group to end the proceedings. The Future Group filed an appeal with the Delhi High Court, challenging the tribunal's decision.

The Kishore Biyani-led Future Group claimed that the Competition Commission of India (CCI) suspended the deal's clearance in December 2021 because Amazon failed to notify it about certain critical details of its acquisition as required under Section 6(2) of the Competition Act, 2002.
