Delhi HC Grants Two-Week Interim Bail to Expelled BJP Leader Kuldeep Singh Sengar on Medical Grounds

Today, the Delhi High Court granted two-week interim bail on medical grounds to Kuldeep Singh Sengar, the expelled BJP leader serving a life sentence for the 2017 rape of a minor in Uttar Pradesh.

A bench led by Justice Prathiba M. Singh temporarily suspended his sentence, ordering that Sengar be admitted to AIIMS Delhi for medical evaluation. He is also required to remain in the capital upon his discharge.

"Considering the history of the case as also the medical condition of the applicant, it is directed that the applicant will be released on interim bail for two weeks & he shall seek admission in AIIMS Delhi for a comprehensive medical evaluation," the bench, also comprising Justice Amit Sharma, said.

The Court seeks a report from the medical board at AIIMS and scheduled the matter for hearing on December 20.

Sengar is also serving a 10-year sentence in connection with the custodial death of the Unnao rape victim’s father. His plea for interim bail in that case is still pending before another bench of the High Court.

Sengar sought interim bail on medical grounds, citing ailments such as cataracts that required immediate attention. This request was opposed by both the victim’s lawyer and the CBI.

He has sought the quashing of the December 2019 judgment by the trial court, which sentenced him to life imprisonment for the remainder of his life.

The girl was kidnapped & raped by Sengar in 2017 when she was a minor.

On March 13, 2020, Sengar was sentenced to 10 years of rigorous imprisonment and fined Rs 10 lakh in connection with the custodial death of the rape victim's father. The court also sentenced Sengar's brother, Atul Singh Sengar, and five others to 10 years in prison.

The rape victim’s father was arrested at Sengar's instigation in a case under the Arms Act and died in custody on April 9, 2018.

Following a Supreme Court order on August 1, 2019, the rape case and related cases were transferred from a trial court in Uttar Pradesh to Delhi.

Sengar’s appeal challenging the trial court’s verdict in the main Unnao rape case is also pending before the High Court.
