On Wednesday, the Delhi High Court granted BJP leader Subramanian Swamy additional time to file a copy of a petition currently pending before the Allahabad High Court concerning Congress leader Rahul Gandhi's citizenship.
Swamy informed the court that he had obtained the petition copy and clarified that the prayers in the Allahabad case differ from those in his own plea.
A bench comprising Chief Justice Manmohan and Justice Tushar Rao Gedela directed Swamy to submit the documents electronically, in line with its previous order, and scheduled the next hearing for November 6.
Swamy's plea requests the Ministry of Home Affairs (MHA) to make a decision on his representation, which seeks the cancellation of Rahul Gandhi's Indian citizenship. Additionally, Swamy has asked for a status report from the MHA regarding his earlier representations.
At the outset of the hearing, Swamy emphasized that the petition pending before the Allahabad High Court does not overlap with his case, to which the bench responded, "Okay, we will see." The court had previously asked Swamy to obtain the petition copy to ensure that the two courts were not simultaneously addressing the same issue.
The Delhi High Court noted that it was crucial to review the pending petition in the Allahabad High Court to proceed fairly in the case.
Swamy, represented by advocate Satya Sabharwal, had written to the MHA in 2019, alleging that Gandhi had disclosed to the British government that he held British nationality. This, Swamy contends, would violate Article 9 of the Constitution, along with provisions of the Indian Citizenship Act.
A related public interest litigation (PIL) is being heard by the Allahabad High Court's Lucknow bench, in which BJP worker S Vignesh Shishir from Karnataka claims to have new evidence suggesting Gandhi holds British citizenship.
