Delhi HC Dismisses Plea Seeking Rehabilitation Package for Migrants from Pakistan under CAA

The Delhi High Court recently dismissed a petition by Akhil Bhartiya Dharma Prasar Samiti, which sought directions to the Central Government for the provision of a rehabilitation package to migrants from Pakistan who acquired Indian citizenship under the Citizenship (Amendment) Act (CAA), 2019.

The bench of Acting Chief Justice Vibhu Bakhru and Justice Tushar Rao Gedela noted that such policy decisions are within the government's purview and are not subject to court intervention.

The petitioner argued that a significant number of migrants, residing in camps across Delhi, lived in substandard conditions and required essential facilities like shelter, healthcare, education, and sanitation.

Advocate Divita Dutta, representing the petitioner, pointed out the urgency of the situation.

The court observed that the petitioner had already submitted a representation to the authorities, urging them to address these issues. As a result, the court dismissed the petition, instructing the government to consider the representation and provide a reasoned decision.
