Delhi HC Dismisses PIL Demanding Sewage and Garbage Disposal in Unauthorised Colony

The Delhi High Court dismissed a PIL petition on Tuesday that sought directions for authorities to furnish sewage and garbage disposal amenities in an unauthorized colony within the national capital.

The Division Bench of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora, in rejecting the PIL, posed the question of whether the Court should mandate sewage facilities if someone were to encroach on High Court land in the future.

The Bench emphasized that remedies such as writ petitions cannot be utilized by individuals encroaching on government land.

Sarva Seva Trust filed a PIL seeking directives for the Municipal Corporation of Delhi (MCD) and the Delhi government to provide sewage facilities and establish garbage disposal arrangements in a colony.

It was brought to the Court's attention that the colony in question is unauthorized, and whenever the MCD attempts to introduce facilities in the area, residents from neighboring areas raise objections.

After deliberating on the arguments presented, the Bench concluded that the residents of the unauthorized colony are effectively encroaching on government land, and therefore, the Court declined to issue any directives on the plea.
