The Delhi High Court has mandated Ashneer Grover to eliminate any defamatory or derogatory content targeting BharatPe and its officials. This legal intervention follows a series of contentious incidents that transpired over time.
The bench of Justice Prathiba M. Singh issued a specific instruction to Ashneer Grover, directing him to remove disparaging posts within a stringent timeframe of 48 hours from the order's issuance. Additionally, the court expanded its jurisdiction to require the removal of an article published by the Economic Times on March 7, which was based on Grover's communications with the RBI Chairman.
The origins of this legal saga trace back to a preceding court ruling in May 2023. At that time, the court had already prohibited Grover from using 'unparliamentary' and 'defamatory' language concerning the company. Additionally, Grover faced a fine of INR 2 lakhs for disregarding explicit court directives.
The recurrence of such allegations suggests an ongoing conflict between Grover and BharatPe, characterized by repeated legal interventions to curtail defamation and derogation.
Senior Advocate Akhil Sibal, representing BharatPe, put forth arguments asserting that the contentious article was based on letters authored by Grover. These letters alleged fraudulent activities by the company in relation to regulatory bodies, consequently damaging its reputation and goodwill.
On the contrary, Advocate Giriraj Subramanium, representing Grover, argued that the article was founded on an external report beyond their influence, which would have become public knowledge regardless of their actions.
