Recently, the Delhi High Court directed the Delhi Government that employment market portals should not post any job advertisement that does not comply with the Minimum Wages Act- 1948.
A division bench of Chief Justice Satish Chandra Sharma and Justice Sanjiv Narula also noted the government's submission that steps are being taken to update the software portal so that not a single advertisement showing wages less than the prescribed minimum wages is uploaded.
The court gave the said order while hearing a PIL seeking to stop any person, company, organization or establishment from advertising job vacancies with salary less than the prescribed minimum salary on its official portal. On the petition, Delhi government filed an affidavit saying that the market portal was launched to help the people affected by the Corona epidemic.
A software was developed to enable anyone to post jobs irrespective of job categories and specifications. Not only this, some employers registered on the portal were advertising job vacancies at less than the prescribed rates of minimum wages notified by the Labor Department of Delhi Government.
The petition was filed by a law student of Jamia Millia Islamia University demanding enforcement of labor laws and abolition of bonded labor in the national capital. The petitioner had argued that job opportunities for the posts of office boy, cook, waiter, computer operator, delivery boy, kitchen helper, ambulance driver, peon, security guard etc. are being advertised with salaries less than the prescribed minimum salary.
