The Delhi High Court has instructed the Delhi Police and the Municipal Corporation of Delhi (MCD) to assess the viability of hosting a public gathering, specifically the All India Muslim Mahapanchayat, at the Ramlila Ground on December 18.
The bench of Justice Subramonium Prasad has ruled that the application previously submitted by the organization, Mission Save Constitution, requesting to conduct the Mahapanchayat on December 18, should be regarded as a formal representation.
The court was addressing a plea presented by the organization, urging authorities to act upon their request and issue a No Objection Certificate (NOC) for hosting the public assembly at Ramlila Ground. Founded by Advocate Mehmood Pracha, the organization asserts its commitment to fostering awareness among the general populace, particularly marginalized communities, regarding their constitutional rights.
Initially, permission was sought for the public gathering on December 04, but the Municipal Corporation of Delhi (MCD) cited the unavailability of Ramlila Ground for that date. However, they indicated the possibility of allotting the venue contingent upon obtaining a No Objection Certificate (NOC) from the Delhi Police. The Delhi Police, on their part, mentioned that they had already granted an NOC to Maha Tyagi Seva Sansthan for conducting the 'Mahayagya for Vishwa Jan Kalyan' at Ramlila Ground scheduled from December 03 to December 15. Consequently, the venue was already allocated for that period.
The court acknowledged that the venue was unavailable for December 04 due to prior allocation. It clarified its stance, stating it wouldn't delve into the dispute regarding whether Maha Tyagi Seva Sansthan should have initially approached the MCD before the Police Authorities or vice versa, or the sequence followed by the petitioner organization in their applications. The organization's counsel presented that among the dates proposed by both the MCD and the Police Authorities, December 18 emerged as the most suitable and convenient option for conducting the Mahapanchayat.
The matter will now be heard on November 28.
